What are cookies?
Cookies are little text files which are sent by the website visited by the user to the user's device (usually to the browser), where they are stored so as to recognize such device at the next visit. At each following visit, indeed, the cookies are sent back by the user's device to the website.
Cookies can be installed, however, not only by the manager of the website visited by the user (first-party cookies), but also by a different website which installs the cookies through the first website (third-party cookies) and can recognize them. This happens because on the website visited there could be elements (images, maps, sounds, links to web pages of other domains, etc.) which reside on servers other than that of the website visited. According to what is provided for in the Privacy Watchdog's Measure (Provvedimento del Garante della Privacy) of the 8th of May, 2014 "the individuation of the simplified modalities for the information report and the consent acquisition for the use of cookies" (hereinafter "Measure"), for the cookies installed by third parties, the duties concerning the information report and, if applicable, the consent are the third party's responsibility. The website owner, as a technical intermediary between the third parties and the users, has to insert in the extended information report the up-to-date links to the information reports and the third parties' consent forms.
Depending on their purpose, cookies are classified into technical and profiling cookies.
Technical cookies are only installed in order to "carry out the transmission of communication on an electronic communication network, or to the extent strictly necessary to a service provider of the information society service" (cf. Art. 122, par. 1, of the Legislative Decree (D.Lgs) 196/2003 – the so-called Privacy Code, as modified by Legislative Decree 69/2012). They are generally used for allowing efficient navigation through pages, storing the users' preferences, storing information about specific users' configurations, performing the users' login, etc. Technical cookies can be classified into navigation and functional cookies. The navigation cookies are used for recording data that are helpful in the normal navigation and use of the website on the user's computer (allowing, for example, to remember the preferred page dimension in a list). The functional cookies allow the website to remember the choices made by the user with the aim of optimizing their functionalities (for example, the functional cookies allow the website to remember the user's specific settings, such as the country selection and, if set up, the state of permanent access). Some of these cookies (called 'essential' or 'strictly necessary') enable functions without which it could not be possible to carry out some operations. According to the above-mentioned art. 122, par. 1, Privacy Code, the use of technical cookies does not require the users' consent.
The so-called analytics cookies are considered technical cookies, if they are used by the website manager for the website optimization, for collecting aggregated information about the number of users and the way they visit that website. Therefore, as specified in the Measure, for the relevant installation the users' consent is not required).
The profiling cookies are used for tracking the users' navigation, analyzing their behaviour, with marketing purposes, and creating profiles of their tastes, habits, choices, etc., so as to transmit tailor-made advertisements on the basis of the users' interests and in line with the preferences they show during their on-line navigation. Such cookies can be installed on the users' device only if they have expressed their consent with the modalities indicated in the Measure.
Depending on their duration, cookies are classified into persistent, which are stored in the user's device until their expiration, unless the user removes them, and session cookies, which are not stored persistently in the user's device and disappear when the browser is closed.
